Terms and Conditions for Captains

A. General Terms
These Terms and Conditions apply to independent captains, drivers, riders and vehicle operators who access or use the IndiCab platform to receive ride, delivery or other mobility service requests.
By applying for onboarding, creating a captain account, accessing the IndiCab Rider application or using any IndiCab service, you confirm that you have read, understood and agreed to these Terms and Conditions.
1. Independent Status
Captains are independent service providers and are not employees, agents, representatives, partners or joint-venture participants of IndiCab.
Captains may choose whether to go online and whether to accept available service requests, subject to applicable platform rules, customer safety standards and applicable laws.
2. Eligibility and Documents
You must provide true, accurate, current and complete information during registration and onboarding.
The required information may include your identity proof, address proof, photograph, driving licence, vehicle registration certificate, insurance, permits, tax information, bank account details and any other documents required by IndiCab or applicable law.
IndiCab may reject, delay, suspend or deactivate your onboarding or account if any information or document is missing, expired, inaccurate, fraudulent, unverifiable or otherwise non-compliant.
3. Vehicle and Safety Duties
You are responsible for keeping your vehicle roadworthy, clean, properly maintained, insured, registered and legally permitted to provide the applicable services.
You must comply with all traffic laws, transport regulations and safety requirements. You must not drive recklessly, dangerously or while under the influence of alcohol, illegal substances or any medication that may impair your ability to drive safely.
You must wear and provide safety equipment where legally required and maintain professional, respectful and non-discriminatory conduct with customers and other platform users.
4. Service Requests and Cancellations
When you accept a ride or service request, you should proceed to the pickup location and complete the service safely, professionally and within a reasonable time.
Repeated avoidable cancellations, refusal to complete accepted services, fraudulent activity, manipulation of fares or routes, harassment, unsafe conduct or misuse of the platform may result in warnings, account restrictions, suspension or permanent deactivation.
5. Earnings, Payments and Taxes
Captain earnings, fares, incentives, bonuses, commissions, service charges, deductions and settlement periods may vary depending on the service type, location, demand, payment method, campaign conditions and applicable platform rules.
You are responsible for reviewing your earnings and transaction records and reporting any genuine discrepancy within the applicable support period.
Captains are independently responsible for their own taxes, licences, permits, fuel, vehicle maintenance, insurance, mobile-data costs and other business or statutory expenses.
6. Customer Information
Customer names, telephone numbers, pickup locations, destination locations, trip information and other customer details are provided only for completing legitimate ride-related or service-related activities.
Captains must not misuse, copy, sell, publish, disclose or retain customer information for any unauthorised purpose. Captains must not contact customers after completion of a service unless reasonably required for a legitimate service-related matter.
7. Background Location Access and Consent
IndiCab Rider requires access to your device's location while the application is in use and, with your explicit permission, while the application is running in the background.
Background location access is required to provide essential captain and ride-management features while you are online or completing a trip.
IndiCab Rider may collect and use your background location for the following purposes:
- To identify your current position while you are online and available to receive ride requests.
- To send relevant nearby ride or service requests to your device.
- To enable live location tracking during an accepted or active trip.
- To provide accurate pickup, drop-off, routing and navigation services.
- To calculate estimated arrival time, trip distance and service progress.
- To share necessary real-time trip progress with the customer during an active service.
- To support captain and passenger safety, emergency assistance, customer support, fraud prevention and dispute resolution.
- To maintain the operation of an active trip when the application is minimised, the screen is locked or another application is being used.
Background location may be collected when you are marked as Online, available to receive service requests, travelling towards a pickup location or completing an active ride or service.
IndiCab does not intend to collect background location after you have gone offline and no ride or service remains active, except where technically necessary for a short period to complete processing, prevent fraud, investigate a safety incident or comply with applicable law.
Before requesting Android location permission, IndiCab Rider will display a prominent in-app disclosure explaining:
- What location data is accessed or collected.
- Why background location access is required.
- When background location may be collected.
- How the location data benefits the captain and customer.
The location permission request will only proceed after you take an affirmative action, such as tapping the Continue button on the disclosure screen.
By tapping Continue and granting the requested device permissions, you expressly consent to IndiCab accessing, collecting and using your location, including background location, for the purposes described in these Terms and the IndiCab Privacy Policy.
You may select Not Now, deny the permission or revoke location permission at any time through your device settings. However, denying or disabling location permission may prevent you from going online, receiving ride requests, using navigation, sharing trip progress or completing rides through the IndiCab Rider application.
8. Location Data Sharing
Your location data may be shared only where reasonably necessary to operate the platform and provide the requested services.
Location data may be shared with:
- Customers during an accepted or active ride, where required to display your approach, arrival or trip progress.
- Mapping, navigation, cloud-hosting, analytics, communication and technical service providers that process information on behalf of IndiCab.
- Emergency services, law-enforcement authorities, courts or government agencies where required by law or necessary to address a genuine safety incident.
- Authorised IndiCab personnel for support, safety review, fraud prevention, complaint investigation and platform administration.
IndiCab does not sell captain background-location data to third parties for their independent advertising purposes.
9. Location Data Retention and Security
IndiCab may retain trip and location-related information for as long as reasonably necessary to provide services, process payments, resolve complaints, prevent fraud, maintain safety records and satisfy legal or regulatory obligations.
IndiCab applies reasonable administrative, organisational and technical safeguards to protect personal and location data. However, no electronic transmission or storage method can be guaranteed to be completely secure.

10. Captain Account and Device Security
You are responsible for keeping your account credentials, password, one-time password and registered device secure.
You must not allow another person to use your captain account or impersonate you while providing services. You must promptly notify IndiCab if you suspect unauthorised account access, device theft or misuse.
11. Prohibited Activities
Captains must not:
- Create fake bookings, trips, accounts or transactions.
- Manipulate GPS, location, routes, fares, incentives or platform records.
- Use location-spoofing, fake-GPS or other unauthorised software.
- Share or rent their captain account to another person.
- Harass, threaten, discriminate against or harm customers.
- Use customer or platform information for unauthorised purposes.
- Interfere with the operation, security or integrity of the platform.
12. Suspension or Termination
IndiCab may temporarily restrict, suspend or permanently deactivate captain access for reasons including:
- Missing, expired, inaccurate or fraudulent documents.
- Safety complaints, dangerous driving or serious misconduct.
- Fraud, payment manipulation or GPS manipulation.
- Misuse of customer information or platform data.
- Violation of applicable law or platform policies.
- Repeated cancellations or poor service quality.
- Failure to cooperate with a legitimate safety or compliance review.
13. Changes to These Terms
IndiCab may update these Terms from time to time to reflect changes in the platform, legal requirements, safety standards or business operations.
The revised Terms will be published with an updated effective date. Continued use of the IndiCab Rider application after an update may constitute acceptance of the revised Terms, subject to applicable law.
14. Governing Law
These Terms shall be interpreted in accordance with the applicable laws of India. Any dispute shall be subject to the jurisdiction of the competent courts applicable to IndiCab's registered business location, unless otherwise required by law.
